So be on the lookout, R. Kelly's new album Buffet, is due Sept. 25.  In the meantime, a third person has come forward claiming the story line for the hit FOX drama Empirewas their idea.

As previously reported, there's already two lawsuits pending against the TV drama's creator Lee Daniels and Terrence Howard.  Legal docs on both cases have similar claims, and seeking damages from $300 million to $1 billion dollars.  Now AllHipHop reports Marvin Gaye's son, Marvin Gaye III, is throwing his hat in the ring.

Gaye III claims Empire was his idea and that he registered the script for it in 2010, with the Writers Guild of America.  The Motown legends son says he pitched the show to different network execs, including some whom supposedly had ties to Lee Daniels.   Gaye named his series Diamonds & Ballads and calling it the "black Dynasty."

He said he based the show on the lives of his own family as well as Berry Gordy’s.  He claims Daniels confessed to stealing his idea while being interviewed by the NewYork Times when he unknowingly discribed the show as a “black Dynasty.”
