New Orleans, La. — According to reports, former Saints defensive end Will Smith had a blood alcohol content of 0.24 when he was shot and killed during an altercation in the Lower Garden District on April 9, 2016.

Though toxicology results have not been made public, unauthorized sources contacted various news outlets with this latest information “on condition of anonymity,” said NOLA.com. If Smith’s alleged blood alcohol content was 0.24 percent, that would have put him three times the legal 0.08 percent limit allowed in Louisiana.

The families attorney has previously said that Smith was not inebriated where he could not drive on the night he was killed during an altercation and called claims from the defense "absolutely false,” amongst others.

Smith’s wife Racquel, was also wounded during the altercation when she was shot twice, and recovered at a local hospital.

The shooter Cardell Hayes has since been indicted on murder charges, but his lawyers claim he is not guilty and that the the shooting was in self-defense.
