C-Murder’s Request for Murder Case Retrial Gets Denied by Judge
Despite two witnesses recanting their statements in his case, a judge has denied a retrial for C-Murder, who was convicted of second-degree murder in 2009 for a 2002 nightclub killing.
According to a report The New Orleans Advocate's posted Thursday (Jan. 24), Judge Steven Enright of 24th Judicial District Court ruled that C-Murder's defense did not make a decent case for post-conviction relief. In fact, Enright believes the recantation of both witnesses' testimony are "highly suspicious" and are "tantamount to perjury."
C-Murder's attorney Paul Barker argued that the second-degree murder conviction should be either thrown out or a hearing to argue the matter in court should be granted. Barker has been petitioning for a new trial since the second witness in the case, Darnell Jordan, sent a handwritten letter to the 24th Judicial District Court last year claiming that he saw no gun in the rapper's waistband during the fight that preceded the shooting and that the Jefferson Parish Sheriff's Office "tricked" him into identifying C-Murder, born Corey Miller, as the shooter.
However, when he first testified at the first trial in 2003 and the second in 2009, Jordan stuck to his original account, which made Judge Enright shoot down C-Murder and his legal team's hopes of vindication for the No Limit rapper.
"This testimony goes against petitioner's claim that Darnell Jordan was tricked into testifying as he did," Enright wrote.
The other witness, Kenneth Jordan, said he was lying when he told police he saw C-Murder stand over the 16-year-old Steven Thomas during a brawl at the Platinum Club on Jan. 12, 2002, and fire a bullet into his chest. Kenneth, who was working as a security guard at the time, claims investigators had threatened to charge him with killing his infant son, whose death was under investigation at the time, if he didn’t identify C-Murder as the shooter. Yet, the child's mother was later convicted of that murder.
C-Murder, who is the brother of Percy "Master P" Miller and Silkk Tha Shocker, maintains his innocence in the shooting that occurred at the Harvey nightclub in 2002 to this day.
