As previously reported Boston Red Sox  superstar David "Big Papi" Ortiz opened a club in his native Dominican Republic naming it the Forty-Forty club.  Because of that  hip-hop mogul Jay Z  filed a copyright infringement lawsuit against the slugger for naming his spot after Jay's chain of 40/40 clubs.   Jay's string of bars can be found in Manhattan, Las Vegas and Atlantic City.

The lawsuit, filed in Manhattan Federal Court, accused Ortiz of naming his Santo Domingo club Forty-Forty in the hopes of trading in on the rap star's fame.  Hov's lawsuit sought $5 million dollars in damages and for Papi to forfeit of any further use of the 40/40 name.

Federal District Judge Richard Berman was set to rule in the case Tuesday, March 29, 2011.  But looks like he wont have to because the two have agreed to settle the matter.   Judge Berman had previously urged both parties to do just that, and once they agreed in writing the case could be dismissed in as little as 30 days.
Jay's attorney Peter Raymond confirmed the settlement saying " The case has been settled in principal, we have agreed on the outlines of a settlement and need to reduce it to writing."  How much Hov will pocket from the settlement however has not been disclosed.
