Jennifer Hudson’s ex-fiancé David Otunga has filed an emergency motion in their custody battle accusing the Oscar-winning singer of being in contempt by violating a gag order, according to The Blast.

In question is Hudson’s statement to People magazine explaining their split and her protection order against Otunga, which was done in the “best interest of their son.” Hudson and Otunga are the parents of 8-year-old David Daniel Otunga Jr.

In his petition, Otunga claims that Hudson’s statement has damaged his reputation, as well as him being forcibly removed from their home in front of their son.

The former WWE star believes that Hudson got the protective order in order to stop him from getting primary custody of their son. Otunga also claims that J.Hud has been sharing photos of their son despite agreeing to a court order not to do so.

Otunga wants a judge to issue sanctions against Hudson for violating the gag order and is asking that he not be held to a gag order since Hudson doesn’t appear to follow them. In addition, he wants the singer to pay his legal fees.

Attorneys for Jennifer Hudson had no comment on the matter.

Otunga proposed to Hudson in September 2008 but they never married. Their son, David, was born in August 2009.
